4. Eligibility and Permitted Use
You may use the Website only if you are the age of majority in the jurisdiction where you reside and have the legal capacity to enter into a binding contract. If you are under the age of majority, you may use the Website only with the involvement and consent of a parent or legal guardian.
The Website is made available for lawful, personal, and non-commercial use only. You may not use the Website or any DURELLE product, service, content, or material for any illegal, fraudulent, unauthorized, or commercial purpose without our prior written consent.
By using the Website, you represent and warrant that all information you provide to us is true, accurate, current, and complete.
5. Website Account
Certain features of the Website may allow or require you to create an account. You agree to provide accurate, complete, and current information when creating or updating your account.
You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. You agree to notify us immediately at contact@durelle.ca if you suspect unauthorized access to or use of your account.
DURELLE may, in its sole discretion and without notice, refuse registration, suspend or terminate accounts, cancel orders, remove content, or restrict access to the Website where we believe there has been a breach of these Terms of Use, suspicious activity, fraud, misuse of the Website, or any conduct that may harm DURELLE, our customers, or any third party.
6. Products, Availability, and Product Information
DURELLE offers fashion products, including clothing and related items, through the Website. Certain products may be available in limited quantities, available only online, available only by pre-order, or available only while supplies last.
We make reasonable efforts to display product descriptions, colours, images, sizes, measurements, prices, and availability accurately. However, we do not guarantee that product images, colours, textures, measurements, or other product details displayed on your device will be perfectly accurate. Colours may vary depending on your screen, device settings, lighting, and production variations. Sizes and measurements are approximate and may vary slightly.
All product descriptions, prices, specifications, availability, promotions, and offers are subject to change at any time without notice. We reserve the right to discontinue any product at any time.
We do not warrant that any product purchased from DURELLE will meet your subjective expectations regarding fit, look, feel, style, or suitability. You are responsible for reviewing product descriptions, size guides, measurements, and order details before placing an order.
7. Pricing, Currency, Taxes, and Errors
Unless otherwise stated, prices displayed on the Website are listed in Canadian Dollars (CAD).
Prices do not necessarily include applicable taxes, shipping fees, customs duties, import charges, brokerage fees, tariffs, or other charges that may apply to your order. These charges may be calculated at checkout or may be payable separately, depending on your location, shipping destination, and applicable laws.
We reserve the right to correct any errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, availability, or any other information on the Website. We may correct such errors at any time without prior notice, including after you have submitted an order.
If an order is affected by an error, inaccuracy, or omission, we reserve the right to cancel or refuse the order, correct the relevant information, or contact you for further instructions.
8. Orders and Acceptance
Your placement of an order through the Website constitutes an offer to purchase the selected product or products. DURELLE reserves the right to accept, decline, refuse, cancel, or limit any order, in whole or in part, at any time and for any reason permitted by law.
We may refuse or cancel orders where:
a product is unavailable;
there is an error in pricing, description, availability, or shipping information;
payment is not authorized or is reversed;
the order appears fraudulent, suspicious, unauthorized, or inconsistent with normal personal use;
the order appears to be placed by a reseller, distributor, or other commercial buyer;
the shipping address is incomplete, invalid, or outside our serviceable locations;
you have breached these Terms of Use or any other DURELLE policy; or
cancellation is otherwise necessary for operational, legal, or security reasons.
If we cancel an order after payment has been processed, we will provide a refund of the amount paid for the cancelled item or order, subject to applicable law and payment processor timelines.
9. Payment
You agree to provide current, complete, and accurate billing, payment, and shipping information for all purchases made through the Website.
Payments may be processed by third-party payment service providers. DURELLE does not control and is not responsible for the acts, omissions, processing delays, security practices, or terms of third-party payment providers. Your use of a third-party payment method may be subject to that provider’s own terms and privacy policy.
By submitting payment information, you represent and warrant that you are authorized to use the selected payment method and that you authorize DURELLE, or our third-party payment processor, to charge the total amount of your order, including applicable taxes, shipping fees, and other charges.
10. Pre-Orders
Certain DURELLE products may be made available for pre-order. Pre-order products are not immediately available for shipment and may require additional production, processing, quality control, and fulfilment time.
Unless otherwise stated on the applicable product page or in DURELLE’s Pre-Order Policy, DURELLE’s pre-order processing time is approximately 8 to 12 weeks. This processing period is an estimate only and does not guarantee a specific delivery date. Pre-order timelines may be affected by production schedules, fabric or material availability, quality control, shipping delays, customs processing, weather events, carrier delays, supplier delays, or other circumstances beyond our reasonable control.
By placing a pre-order, you acknowledge that you have reviewed and agreed to DURELLE’s Pre-Order Policy. The Pre-Order Policy governs pre-order timelines, payment timing, cancellation requests, delays, fulfilment changes, and any refund rights relating to pre-order items.
11. Shipping and Delivery
DURELLE ships worldwide, subject to applicable laws, carrier availability, operational restrictions, and any shipping limitations stated on the Website or in our Shipping Policy.
Shipping and delivery times are estimates only and are not guaranteed. Delivery times may vary depending on product availability, pre-order processing, destination, customs clearance, carrier performance, weather, public holidays, and other factors beyond our control.
You are responsible for providing accurate and complete shipping information. DURELLE is not responsible for delays, failed deliveries, lost packages, or additional charges resulting from incorrect, incomplete, or outdated shipping information provided by you.
For international orders, you are responsible for any applicable customs duties, import taxes, brokerage fees, tariffs, or other charges imposed by the destination country. DURELLE is not responsible for delays caused by customs or import processing.
Shipping matters, including delivery estimates, shipping fees, customs duties, wrong addresses, lost or delayed packages, and international shipping responsibilities, are governed by DURELLE’s Shipping Policy.
Title and risk of loss in products pass to you when the order is delivered to the carrier for shipment, unless otherwise required by applicable law.
12. Returns and Refunds
DURELLE accepts eligible returns within 14 days of delivery, subject to the conditions, exclusions, procedures, and timelines stated in DURELLE’s Return and Refund Policy.
To be eligible for return, items must satisfy the requirements stated in the Return and Refund Policy, including requirements relating to condition, tags, packaging, proof of purchase, return authorization, final sale exclusions, and return timelines.
Shipping fees, customs duties, import charges, and other third-party charges may be non-refundable unless otherwise required by applicable law or expressly stated in DURELLE’s Return and Refund Policy.
DURELLE reserves the right to inspect returned items before issuing a refund and to refuse returns that do not meet the requirements of the Return and Refund Policy.
13. Promotions, Discounts, and Offers
DURELLE may offer promotional codes, discounts, sales, or special offers from time to time. Promotions may be subject to additional terms, restrictions, eligibility requirements, expiry dates, and exclusions.
Promotional offers are not redeemable for cash, may not be combined with other offers unless expressly stated, and may be modified, suspended, or cancelled at any time.
We reserve the right to cancel orders or refuse promotions where we believe a promotion has been misused, obtained fraudulently, applied in error, or used in violation of the applicable promotional terms.
14. Intellectual Property
The Website and all content, materials, designs, text, graphics, images, photographs, videos, logos, icons, product names, trade names, trademarks, service marks, software, layout, look and feel, and other materials available on or through the Website are owned by or licensed to DURELLE and are protected by Canadian and international intellectual property laws.

If you submit, post, send, or otherwise provide any reviews, comments, photographs, testimonials, feedback, ideas, suggestions, designs, proposals, or other materials to DURELLE, whether through the Website, email, social media, surveys, or otherwise, you agree that such submissions are non-confidential and non-proprietary unless otherwise agreed in writing.
By providing a submission, you grant DURELLE a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable licence to use, reproduce, modify, adapt, publish, translate, distribute, display, and otherwise exploit the submission for any lawful business purpose, including marketing, advertising, product development, customer service, and website content, without compensation to you.
You represent and warrant that your submissions do not violate any third-party rights, including intellectual property, privacy, publicity, personality, or contractual rights, and do not contain unlawful, misleading, defamatory, obscene, abusive, offensive, or harmful content.
DURELLE may, but is not required to, monitor, edit, remove, refuse, or disable any submission at any time.
